A transsexual woman in Hong Kong has sought the help of the courts in obtaining the right to marry. The woman, identified only by the letter W, was born a man. She has since undergone gender reassignment surgery and is now listed as a female on both her passport and identification card. The government has denied her the right to marry as her birth certificate still states she is a male, and same sex marriage is prohibited. Her lawyers argue that marriage laws should have some elasticity as sexual identity is subject to change, and such a case is not about same sex marriage. The judge hearing the case has said that the courts alone may not be enough to tackle the issue. Further legislation may also be necessary.
